These following Terms and Conditions govern the use of the website www.voyagesjourneys.com (hereinafter referred to as the “website”) and apply to the services provided by Portugal 720/2 Unipessoal, Lda (referred to as “Portugal360” or as “we”). We may refer to the client as “client” or just “you”. As this affects your legal rights, please read the following terms and conditions carefully in addition to our privacy policy.

1. Acceptable use:

It is a violation of law to purchase products or services from Portugal360 in a false name, or with an invalid credit card or other payment method. Fraudulent users can be prosecuted to the fullest extent of the law.

 

2. As is:

Unless agreed otherwise, all products, services, advice, merchandise and information available through this website are provided on an “as is”, “as available” basis, without warranties, either expressed or implied, including but not limited to, implied warranties of fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made regarding: (i) the purchase of any product or service; (ii) receiving the lowest available price for goods and/or services; (iii) the availability of products and/or services; (iv) the inexistence of errors in the use of this website and products or services associated with it; (v) the results that may be obtained from the use of this website; (vi) the completeness, accuracy, reliability or quality of any information content, data, service, advice or product provided or available through this website; or (vii) the performance or non-performance of this website. You expressly agree that the use of this website at your sole risk.

 

3. General limitation of liability:

Portugal360 responsibility shall be limited to the maximum amount required by the regulator in Portugal and according to its Civil Liability. In no event shall Portugal360, including Directors, Employees, Representatives, Affiliates, or other Service Providers (collectively defined as the “Covered Parties”), be liable beyond the limits foreseen by the Civil Liability. Further, the Covered Parties accept no responsibilities for any damage and/or delay due to third parties’ cancellations, shortages, sickness, pilferage, labour disputes, quarantine, government restraints, weather or causes beyond the Covered Parties’ control. Covered Parties shall not be responsible for any provider’s failure to comply with these Terms and Conditions nor for any provider’s failure to comply with applicable law.

 

Providing that Portugal360 have selected the suppliers with reasonable care, Portugal360 will have no liability for anything that happens during the service in question or any acts or omissions of the supplier, its employees or agents.

 

If, notwithstanding the above, any of the Covered Parties is found liable for any loss or damage relating to the use of this website, the client agrees that the liability of any such party shall in no event exceed the fee or charge that the client would have with the respective service or product.

 

Nevertheless, Portugal360 will do its utmost to assist its clients in the event of non-compliance by other parties or any disruption to the desired service, aiming to deliver to the client the product or service that was contracted.

4. E-mail policy:

Portugal360 may send e-mail messages about special promotions, new features, services, products, and any other information that considers relevant. However, if the client does not want to receive e-mail messages regarding products and services should contact us or unsubscribe and will be removed from the database.

 

5. General bookings and reservations:

When the client books and makes a reservation must pay 100% of the total price of the purchased service. If the trip booked by the client is a combined program, not subject to automatic reservation procedures, a 50% advance payment shall be made, and the remaining 50% shall be paid until 90 days before the start of the trip (can be less depending on the services contracted and upon agreement).

 

Exceptions are made when suppliers require different payment conditions, regardless of the reservation anticipation, whereby the conditions of those suppliers prevail. If applicable, the client should be informed on the amount to be paid as soon as is informed on the price.

 

The pre-determined payment should be made to confirm the reservation. Reservations shall be conditional upon confirmation of all services by suppliers.

 

A booking is made with Portugal360 when either a client confirms that would like to accept our written or verbal quotation; or when a deposit is made. Deposits are non-refundable.

 

6. Flight reservations:

The responsibility for availability, time, type of equipment, stopovers and airport information falls entirely upon airline companies. The client must reconfirm the flight time(s) with the airline company. Portugal360 cannot be held responsible for any change in flight times by airline companies.

 

Price information given by search tool or travel consultant is based on flight availability for that time and, at least, for 1 passenger. The quoted prices may not include additional services as for instance meals on board, luggage, check-in, etc. The client, if not informed at the moment of the reservation, shall get in contact with Portugal360.

 

Fares are usually restrictive and non-refundable; this information being made available before reservation.

 

Portugal360 is not responsible for any luggage. The client has the obligation to submit a complaint to the service provider entity in case of deduction, deterioration or destruction of his luggage. In case of damage in his luggage, the complaint shall be addressed in writing to the carrier immediately after the damage, within 7 days at the utmost, from delivery of the same (may vary between airlines). If there is a delay in delivering the luggage, the complaint shall be made within 21 days as from the delivery of the same (also may vary between airlines).

 

The client must have all the personal and family documentation valid, (identity card, military documents, minors travel authorization, visas, vaccination certificate, and/or others that may also be required). Portugal360 declines any responsibility for visa denial or non-permission to enter a country; any cost that the client may incur with this shall entirely be for the client’s account and risk. Furthermore, the client agrees to reimburse Portugal360 in relation to any fines or other losses which we incur as a result of failure to comply with any passport, visa, immigration requirements or health formalities.

 

7. Accommodation reservations:

Portugal360 offers accommodation reservation in its website, through reservation call centres and/or direct contact. Suppliers are entirely responsible for accommodation availability and rates. Disclosed rates are dynamic and are subject to change if reservation is not immediately made.

 

Any special requests shall be reported to service provider and cannot be ensured by Portugal360. The provider makes available a description of its premises and services, being the only one responsible for the disclosed information.

 

Check-in and check-out times, meal plans and drinks may vary and the client, if not informed at time of reservation, should get in contact with Portugal360. 

 

8. Car rental:

Portugal360 acts as an intermediary between the client and the car rental company, forwarding the car rental requests directly to a third-party.

 

The selected supplier shall be responsible for price information, type of vehicle, delivery location and all other information relating to the car rental. The client, when accepting the reservation is subject to the conditions of the hired car rental company.

 

Portugal360 is not responsible for any supplier default.

 

9. Changes and cancellations:

Whenever a client, registered for a certain trip, wishes to change to a different trip or to a different date, or other possible changes, subject to suppliers allowing the request, the client shall pay the difference in rate, plus the expenses associated with that change itself. Whilst Portugal360 will do the best to assist to accommodate the changes, cannot guarantee that will be able to meet client’s requested change.

 

Whenever there are reasonable reasons beyond Portugal360’s control, Portugal360 can change the sequence of routes, change the departure times or replace any of the foreseen hotels for other of similar category and location, keeping the client informed of that change as soon as possible.

 

Listed prices are based in the cost of services and exchange rates in force on the date of its publication. Therefore, are subject to change as a result of the cost of transports, fuel, duties, taxes, rates and/or exchange fluctuations before the date of the trip. In case of exchange fluctuations, the calculation shall be made considering the difference between the exchange rate in force on the date of publication and the date on which this change is reported to the client.

 

The client is free to withdraw from the trip at any time. This cancellation requires that the client will be responsible for the payment of any charges and for a percentage that can amount to up 20% of the total price. Please note that in a cancellation (by the client or in exceptional circumstances by Portugal360), we (Portugal360) are unable to return any costs that we are unable to recover from suppliers, agents, representatives or other parties or entities involved in the design or implantation of the travel plans.

 

If the client is forced to return home early, Portugal360 cannot refund the cost of any services not used. If the client cuts short a trip and returns home early in circumstances where has no reasonable cause for complaint about the standard services provided, Portugal360 may not offer any refund for that part of the trip not completed, nor be liable for any associated costs incurred.

 

10. Complaints:

Complaints can only be considered if submitted in writing to Portugal360 within 30 days after service provision.

 

In case of complaint due to failure to comply with hired services the client is entitled to apply to the Travel and Tourism Guarantee Fund, submitting a complaint to Turismo de Portugal at www.turismodeportugal.pt within 30 days after: (i) the end of the trip; or (ii) trip cancellation; or (iii) having become aware that the trip cannot be made for any reason ascribable to Portugal360.

 

11. Payment:

The following payment methods are available: credit card or electronic (bank) transfer. Portugal360 reserves the right to return a deposit and decline to issue a confirmation at its absolute discretion. The total amount received in the bank must be no less than the full amount shown on the final invoice and paid in the invoiced denomination. If sending money by electronic transfer, then the client must pay all of own banking fees involved in the transfer.

 

Travel documents are issued after payment and proof of payment. Reservations that have not been paid within the deadlines provided or in case suspicion of fraud can be cancelled.

 

In case of suspicion of fraud with credit cards, Portugal360 may request a copy of the credit card used and a copy of the user’s identification document.

 

In case of a situation of fraud, services are automatically cancelled even if travel documents have already been issued or even if the trip and/or stay has already started.

 

12. Insurance:

It is a condition that the client is fully insured for the selected destinations, activities and personal requirements. Please be advised that insurance should include health and repatriation, including search and rescue for all activities. Policies should also include adequate cancellation and personal belongings (whether by theft, damage or loss) insurance to the full value of the trip and activities.  The client can be required to provide documentary evidence of travel insurance prior to departure. Portugal360 reserves the right to refuse participation on a trip if no proof of adequate, valid insurance for the trip and planned activities is provided. Please note that, while we may require evidence that the client has obtained insurance cover, we will not check the chosen insurance policy for suitability, and we make no representations that it is appropriate for the needs.

 

In case of a suspected or confirmed emergency involving the client or the group of which is a member, Portugal360 reserves the right to arrange (or to make arrangements for its or client’s insurers to arrange) search, rescue and recovery as it deems appropriate and reasonable. The client agrees to indemnify Portugal360 and keep Portugal360 indemnified from all costs and losses, arising from any such search, any such helicopter usage and any resulting repatriation (for medical or non-medical reasons), legal costs (if any), and any other cost resulting from it.

 

13. Legislation and jurisdiction:

All disputes arising out of or in connection with the interpretation or execution of these terms and conditions shall be governed by the Portuguese legislation and the Portuguese version of the same shall prevail.

14. Amendments to terms and conditions:

Portugal360 reserves the right to change these terms and conditions at any time, and whenever necessary informing the client accordingly before the reservation is finalised.
